Dumpster Rental Agreement

This Agreement ("Agreement") is entered into on the date of execution between Elite Clean Outs, Inc. ("Company", "We", "Us", or "Our") and the undersigned customer ("Customer", "You", or "Your"). By scheduling, accepting delivery of, or using any dumpster or junk removal service provided by Elite Clean Outs, Inc., Customer agrees to the following terms of service:

1. SCOPE OF SERVICES PROVIDED

A. Elite Clean Outs, Inc. shall deliver requested size roll-off dumpster to Customer's designated location. Dumpsters are available in 15 or 20 yards. 

B. Dumpster will be placed at Customer's direction subject to site and safety conditions specified in the Agreement.

B. Elite Clean Outs, Inc. shall pick up dumpster at the end of the rental term or upon Customer request. Extensions may be granted for an additional charge depending on availability.

C. Load will be transported to approved disposal facility and disposed of according to applicable laws.

D. Excludes loading by Elite Clean Out's Inc. representatives unless agreed in writing.

E. Excludes disposal of prohibited items listed in the Agreement.

2. PRICING & PAYMENT TERMS

A. A flat rate fee, based on dumpster size, is due at the time of scheduling or upon delivery of dumpster.

B. Disposal is charged at $.05 per pound and due upon receipt of disposal invoice the day of pick-up. Loads smaller than 999 pounds are subject to a minimum disposal fee of $99. 

C. Extension fees are $25 per day after the seven (7) day rental period if dumpster is available. 

D. Cancellation/Rescheduling fee will be charged if done within 24 hours of scheduled delivery.

E. Swap or Dump-and-Return fee is charged for each additional trip to disposal facility and due at the time of redelivery unless otherwise agreed in writing.

F. Prohibited materials fee of $150 PER ITEM will be charged for all prohibited items located in load.

G. Mixed loads, dumpsters containing more than one category of material as detailed in the Customer Responsibilities section of this Agreement, are charged $250 per ton disposal fee.

H. Late payment charges of 1.5% per month will be assessed starting the 8th calendar day after due date.

I. Accepted payments include cash, check payable to Elite Clean Outs, Inc., all major credit cards or on Our website, elitecleanoutsinc.com, Zelle, Cash App, Apple Pay.

3. SCHEDULING, RENTAL PERIODS, EXTENSIONS, & CANCELLATIONS

A. Scheduling is accepted via phone (941-713-5614) or website (elitecleanoutsinc.com).

B. Rental period is up to seven (7) calendar days. Customer may request pickup at any time during the rental period; otherwise, Elite Clean Outs, Inc., will retrieve the dumpster on the 7th day. Dumpster swaps or dump-and-return services are available upon request. The disposal fee for each trip to the disposal facility is due upon disposal.  

C. Cancellation or rescheduling within 24 hours of scheduled delivery are subject to a $100 fee.

4. CUSTOMER RESPONSIBILITIES AND USE OF DUMPSTER

A. Provide unobstructed, safe, and legal access for delivery vehicles, dumpster placement, dumpster pick up, and workers. Choose a suitable placement area on flat ground, free from low wires, tree branches, soft ground, etc.

B. Elite Clean Outs, Inc. is not responsible for any damage to pavement, asphalt, landscaping, driveway, curbs, sidewalks, or underground utilities resulting from dumpster placement or service vehicles when placed as directed by customer.

C. By providing placement suggestions, Elite Clean Outs, Inc. does not assume liability for any damages resulting from placement as Customer has responsibility to pre-investigate placement area.  

D Customer shall be responsible for any overweight fines, fees, or citations arising from overloading dumpster.

E. Customer is responsible for securing HOA approval or permit, if required. 

F. Customer accepts responsibility of ensuring a non-mixed load. Material categories not to mix are

a. HOUSEHOLD - waste, garbage, or unwanted items from within your home

b. YARD DEBRIS - tree branches, leaves, grass clippings, brush. Items NOT considered yard debris are dirt, sand, or soil, fruit, rocks, stones, or bricks, lumber, fencing, plant pots, plywood, or mulch

c. CONSTRUCTION DEBRIS - concrete, shingles, drywall, lumber, steel, glass, and pipes

5. PROHIBITED & HAZARDOUS ITEMS

A. Customer shall not place the following items in any dumpster or request removal of such items unless prior written approval is granted by Elite Clean Outs, Inc. and additional charges are agreed upon.

B. If prohibited or hazardous item(s) or material(s) are found in a dumpster load, Customer will be charged $150 hazardous handling fee PER ITEM PLUS all disposal surcharges assessed by the disposal facility.

C. PROHIBITED OR HAZARDOUS WASTE OF ANY KIND INCLUDING BUT NOT LIMITED TO: 

a. SOLVENTS, PAINTS, FUELS, OILS, ASBESTOS, ADHESIVES, SEALANTS, AND PESTICIDES

b. TREATED WOOD SUCH AS RAILROAD TIES

c. MEDICAL OR BIOLOGICAL WASTE

d. FLAMMABLE OR COMBUSTABLE LIQUIDS

e. BATTERIES, FLUORESCENT BULBS, OR ELECTRONIC WASTE SUCH AS TVS, MONITORS, OR COMPUTERS, TIRES, PROPANE TANKS OR PRESSURIZED CYLINDERS, APPLIANCES CONTAINING FREON OR OTHER REFRIDGERANTS WITOUT PRIOR ARRANGEMENT

f. DIRT, CONCRETE, BRICK, STONE, ROOFING SHINGLES, OR OTHER DENSE MATERIALS UNLESS PRIOR APPROVALIS GIVEN

g. ANY MATERIAL PROHIBITED BY MANATEE COUNTY, THE STATE OF FLORIDA, OR FEDERAL LAW.

D. YARD DEBRIS MUST BE SEPERATED FROM HOUSEHOLD ITEMS AND PLACED INTO A DUMPSTER CONTAINING ONLY YARD DEBRIS OR A $245 PER TON CHARGE WILL APPLY TO THE ENTIRE LOAD. E. CONSTRUCTION DEBRIS MUST BE SEPERATED FROM OTHER TYPES OF DEBRIS AND PLACED INTO A DUMPSTER CONTAINING ONLY CONSTRUCTION DEBRIS OR A $245 PER TON CHARGE WILL APPLY.

6. PROPERTY DAMAGE, LIABILITY, & INDEMNIFICATION 

A. Elite Clean Outs, Inc. is not responsible for:

a. Damages to driveways, curbs, landscaping, or underground utilities caused by dumpster placement or service vehicles as dumpsters are placed per customer direction

b. any injuries caused by unsafe property conditions

c. disposal of Customer misrepresented items (e.g. hazardous waste obscured or hidden in a load).

B. Customer agrees to indemnify Elite Clean Outs, Inc., including all employees, owners and officers of any and all claims, fines or costs caused by misuse, misrepresentation, prohibited items, or unsafe access.

C. Elite Clean Outs, Inc. meets and exceeds all mandatory and recommended insurance coverages for Florida dumpster rental industry.

7. PICK UP TERMS

A. Dumpster must be accessible at scheduled pickup date and time. Overloaded or blocked dumpsters may not be picked up, and customer will be charged a trip fee of $150 in addition to contracted amount.

B. Contents must not exceed the legal road weight or fill limits per dumpster. 15 & 20 yard dumpster maximum weight is 2 to 3 tons or 4,000 to 6,000 pounds. Fill lines are visible on all dumpsters.

8. OWNERSHIP & DISPOSAL

Once removed, items inside dumpster become the property of the Elite Clean Outs, Inc. to dispose of, recycle, or donate. There is no guarantee any removed item will be retrievable or returnable.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.  Any dispute arising under this Agreement must first be submitted to mandatory arbitration or mediation. If unresolved, any legal action shall be filed exclusively in the courts of Manatee County, Florida.

10. SEVERABILITY

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. FORCE MAJEURE

Elite Clean Outs, Inc. is not liable for delays beyond our control such as inclement weather, accidents, etc.

12. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between Customer and Company, superseding any prior written or oral agreements. No amendment or modification shall be valid unless in writing and signed by both parties.
